Tabet DiVito & Rothstein partner John M. Fitzgerald authored an article featured in the December 30, 2025 edition of The Chicago Daily Law Bulletin. The article focuses on how courts interpret legislation and specifically addresses the Illinois Supreme Court’s approach to legislative silence in the Court’s recent decision in Rainey v. Retirement Board of Policemen’s Annuity & Benefit Fund of Chicago. As John observes, the Rainey opinion demonstrates that meaning cannot always be ascribed to the legislature’s silence on a particular issue.
