TDR and the Nelson Mullins firm recently helped their client, a machine manufacturer, obtain a key ruling. As a result of the opinion issued by the United States District Court for the Northern District of Texas, only a single claim of strict product liability remains in a case filed by a worker against TDR’s client.
Judge Ed Kinkeade ruled that the worker could not amend her complaint to add design defect claims against the manufacturer and dismissed her gross negligence claims. In the order, Judge Kinkeade reasoned that allowing the design defect claims “would require a trial continuance, a significant delay the Court is not eager to endorse since it would reward [the worker] for her wavering and lackadaisical approval to the claims.”
